Contents of attorneys' invoices are privileged if they either communicate info. for the purpose of legal consultation or risk exposing info. communicated for such purpose, which includes any invoice that reflects work in active and ongoing litigation.
Privileged information contained in billing invoices submitted in support of an attorney's fees claim may be redacted.
Only fee totals in billing invoices are sometimes subject to disclosure under the Public Records Act; billing entries or other portions of invoices that describe work done for a client are protected by the A/C privilege.
