Court has duty to set 730 expert’s fees.

In allocating costs of a court-appointed custody evaluator, court must consider the parties' ability to pay, whether evaluator is appointed by the court under EC §730 or the Family Code.

Evid. Code §730 experts do not need to be joined in order for the court to determine the reasonableness of their fees.

Trial ct. must set the fee for EC 730 expert; it cannot order a party to pay whatever amount the expert may bill.
