The party discharged from liability is entitled to costs and attorney fees incurred in bringing the interpleader action.

Had lender paid judgment or posted bond while its appeal pending, levied debtors would not have interpled and been awarded atty fees—trial ct. properly found lender necessitated the interpleader and was responsible for the fees.

Because plaintiff who brought interpleader failed to deposit the amount in dispute with the court, order awarding legal fees reversed.
